Volume Analysis

NDIL's case volume provides additional context:

  • Peak volume: 20,202 cases in 2015 -- the highest of any year
  • Pre-COVID average: ~16,000 cases/year (2012--2019)
  • COVID low: 5,063 cases in 2021
  • Post-COVID recovery: 8,889 cases in 2024 -- about half of peak volume

Even at reduced volume, the court is processing nearly 9,000 cases per year -- and dismissing 94.1% of them. At peak volume (2015), the dismissal rate was 72.3%. The post-COVID period has seen fewer cases but higher preliminary dismissal rates.

Prior Filer Analysis

The prior filer rate in NDIL peaked at 48.3% in 2020 -- meaning nearly half the docket consisted of people who had been through bankruptcy before. Key patterns:

  • Prior filer rate grew from 25.8% (2012) to 48.3% (2020) -- nearly doubling
  • It has declined slightly to 40.5% in 2024, but remains elevated
  • The correlation between prior filing and dismissal is strong: districts with high repeat rates have high dismissal rates
  • An estimated 7,607 cases may involve 1328(f) time bar violations

Key Findings

  • 137,366 dismissed cases represent one of the largest concentrations of Chapter 13 dismissals in the country
  • The preliminary dismissal rate rose from 56.3% (2011 mature) to 94.1% (2024 preliminary)
  • 6.1% pro se rate is low -- most filers have attorneys, yet most cases still end in dismissal
  • 7,607 estimated 1328(f) violations -- cases where statutory time bars may have applied at filing
  • At current rates, fewer than 600 of ~8,900 annual filers will receive a discharge
